General information and contact

Adam Wiernasz operates https://ptasiadolina.pl as “Ptasia Dolina” and is the Organiser of the services covered by these Terms.

The Organiser’s current email address, phone number, and correspondence address are displayed in protected form above these Terms and on the Contact page. Social media is an additional contact channel.

Nothing in these Terms limits mandatory Consumer rights.

Using the site

You use the Site in accordance with the law and these terms.

Field and astronomy services

The type, date, place or way of agreeing it, planned duration, price, capacity, and included items are stated in the Offer, booking form, or individual arrangement.

The route and programme may be reasonably adapted to the group’s abilities, safety, nature protection, weather, season, and current field or observing conditions.

The Booker provides accurate contact details and checks the date, Service type, number of places, total price, and key cancellation rules before contracting.

Booking and formation of the contract

Before selecting “Book and pay”, the Booker is shown the selected Service, date, number of participants, total price, and cancellation rules. The button places an order carrying an obligation to pay.

A contract for a paid booking is formed when payment is successfully confirmed, unless the parties expressly agree otherwise. Confirmation and the key terms are sent to the supplied email address.

The acceptance time and version of these Terms are recorded with the booking as evidence. The Booker is responsible for sharing organisational information and these rules with Participants.

A person booking for a minor confirms that they may give the required permissions and will provide adult supervision unless a different arrangement is agreed in writing.

Weather, programme changes, and cancellation by the Organiser

The Organiser may change the route or programme, reschedule, or cancel when safe or worthwhile delivery is prevented or materially hindered by circumstances including adverse weather, official warnings, field conditions, access restrictions, illness or emergency, failure of essential equipment, or force majeure.

For astronomy sessions, cloud, fog, precipitation, strong wind, poor sky transparency, or conditions threatening the equipment may also justify a change. A decision may be taken shortly before the start when the latest forecast or conditions require it.

The Organiser will notify the Booker promptly and propose a new date. The Booker may accept within 7 days of receiving the proposal or request a full refund. No response within that period is treated as choosing a refund.

If the new date is unsuitable or none can be offered, the full amount paid will be returned without undue delay and no later than 14 days, using the same payment method. A voucher or credit requires the Booker’s express consent.

The Organiser does not reimburse accommodation, travel, or other services purchased separately by a Participant unless mandatory law requires it.

Cancellation by the Booker and refunds

Services related to leisure activities or events to be provided on a specific date or during a specific period may fall under the exception in Article 38(1)(12) of the Polish Consumer Rights Act. Where it applies, the statutory 14-day distance-contract withdrawal right is unavailable. Rights that cannot lawfully be excluded remain unaffected.

Independently of that rule, the Organiser voluntarily allows free cancellation and a full refund if the notice reaches the Organiser’s email address at least 72 hours before the Service start time.

For a later cancellation or a no-show, the payment is not refunded because capacity was held, preparation costs were incurred, and the place could not be offered to someone else. The Booker may instead name a replacement Participant free of charge by emailing the Organiser before the start.

Any refund due is made without undue delay and no later than 14 days after effective notice, by the original payment method unless the Booker expressly agrees to another method at no additional cost.

Dynamic nature and observing conditions

Wild animals move freely and their activity depends on season, weather, human pressure, and natural behaviour. The Organiser takes care in choosing the place, time, and approach but cannot guarantee seeing, hearing, or photographing a particular species.

Failure to observe a particular species is not by itself non-performance where the agreed programme was delivered with due care and the promised elements were provided.

Likewise, an astronomy session does not guarantee visibility of a particular planet, deep-sky object, or phenomenon; this depends on weather, sky brightness, season, horizon, and current conditions.

Safety and responsible participation

Participants follow reasonable Organiser instructions, nature-protection rules, and site regulations, keep a safe distance from wildlife, and do not leave the group without notice.

Participants bring clothing, footwear, water, and equipment suitable for the communicated conditions and disclose accessibility needs or limitations relevant to safe participation before booking. Guardians supervise minors at all times.

The Organiser may refuse or end the participation of anyone who is intoxicated, acts dangerously, seriously ignores instructions, or threatens people, nature, or equipment. No refund is due when the reason is attributable to the Participant.

These safety rules do not exclude liability that cannot lawfully be excluded or limited.

Shop

Prices are in PLN and include VAT where applicable.

You place an order via the cart and checkout. Payment is made to the payment operator shown in the checkout process.

A sales contract is formed after the order is placed and payment is confirmed.

Payments

Payments are handled by an external payment operator (Stripe). Card data is processed by the payment operator.

Delivery and order contact details are collected in the checkout or payment form.

Delivery and returns

Delivery and withdrawal rules are described in the “Shipping & Returns” document.

Complaints

A complaint may be submitted by email, phone, or post using the details on the Contact page. To help us investigate, include the Booker’s details, booking number, what happened, and the requested outcome.

The Organiser responds within the time required by law, generally 14 days for Consumers. Consumers may use out-of-court dispute resolution; information is available from UOKiK.

Liability

The Organiser’s liability to Consumers is governed by mandatory law. These Terms do not exclude liability for personal injury or deliberately caused loss.

The Organiser is responsible for conformity with the contract and due care. Natural variability of wildlife or the sky, or a justified route or programme change, does not restrict Participant rights if the Service was otherwise not delivered as agreed.

Final provisions

Polish law applies, provided that this choice does not deprive a Consumer of non-waivable protection under the law of their habitual residence.

Changes to these Terms do not affect bookings made before they take effect; the version accepted at the time of booking governs that booking.

If any provision is invalid, the remaining provisions continue in effect.
